Terms & Conditions

These Terms and Conditions ("Terms") govern your use of Foldward's records organisation services and website. By booking an engagement or contacting us, you agree to these Terms. Please read them before proceeding.
1. Definitions
- "Foldward" — the records organisation service operated from 15 Jalan Pantai, 88000 Kota Kinabalu, Sabah, Malaysia.
- "Client" — any individual or family group who books or requests a Foldward engagement.
- "Engagement" — a scoped service as described in the applicable engagement scope note agreed before work begins.
- "Deliverables" — the physical and digital outputs produced by Foldward at the conclusion of an engagement.
- "Documents" — papers, files, and records belonging to the client and brought to or described during an engagement.
2. Acceptance of Terms
These Terms apply to all clients who engage Foldward for any service. By submitting an enquiry, signing an engagement scope note, or attending an appointment, you confirm that you are 18 years of age or older and have the capacity to enter into an agreement.
3. Description of Services
Foldward provides clerical document organisation services, specifically:
- Two-Column Orientation (RM 455) — a 90-minute session producing a printed orientation sheet and related materials
- Portfolio Build (RM 1,340) — a four-week engagement producing a bound portfolio and related deliverables
- Register, Chronology and Handover (RM 3,760) — a four-month engagement producing a register, chronology, and handover pack
All services are performed in Kota Kinabalu, Sabah. Remote engagements are not currently offered.
4. What Foldward Does Not Do
Foldward is a clerical and records organisation service. The following activities fall outside our scope and are not part of any engagement:
- Legal advice, legal representation, or correspondence on a client's behalf
- Estate administration or probate services
- Financial advice, asset valuation, or investment guidance
- Interpretation of legal instruments or court documents
- Any activity requiring a professional licence or registration under Malaysian law
This boundary is stated in writing in every engagement scope note and is not subject to negotiation or modification.
5. Scope Notes and Agreement
Before any engagement begins, Foldward provides a written scope note describing the service, duration, deliverables, price, and limitations. No work begins until the scope note is agreed. Changes to scope during an engagement require a written amendment agreed by both parties before additional work proceeds.
6. Payment Terms
All prices are in Malaysian Ringgit (RM) and are inclusive of applicable taxes. Payment is due as follows:
- Two-Column Orientation: full payment before the session date
- Portfolio Build: 50% at booking, 50% at delivery of the bound portfolio
- Register and Handover: 25% at booking, 25% at month two review, 50% at handover
Accepted payment methods include bank transfer and cash at the Kota Kinabalu office. No work or appointment will be scheduled until the required deposit is received.
7. Cancellation and Rescheduling
- Cancellations made more than 5 working days before a session receive a full refund of any deposit paid.
- Cancellations made within 5 working days of a session forfeit the session deposit.
- For multi-appointment engagements, cancellation after work has commenced results in a charge for the portion of work completed, assessed on a pro-rata basis.
- Rescheduling requests made at least 3 working days before a session are accommodated where possible at no additional charge.
8. Client Responsibilities
The client is responsible for:
- Bringing documents to appointments as discussed
- Ensuring they have the authority to share and organise the documents provided
- Setting up and controlling their own digital storage accounts for the digital mirror
- Maintaining the portfolio after the engagement using the maintenance sheet provided
9. Document Handling
Foldward handles client documents with care. Originals are never marked, stamped, or permanently altered. Working copies are made only as needed for the engagement and are destroyed after the final deliverable is handed over. The client retains ownership of all documents at all times.
10. Intellectual Property
The engagement scope notes, orientation sheets, glossaries, checklists, maintenance sheets, and practitioner directories produced by Foldward are proprietary materials. Clients receive a non-exclusive licence to use them for their own family purposes. These materials may not be resold, redistributed, or used commercially without written permission from Foldward.
11. Disclaimers
Foldward's deliverables are produced from the documents clients bring. We do not independently verify the accuracy, completeness, or legal status of any document. Deliverables are presented as clerical outputs and should not be relied upon as legal, financial, or professional advice. Where gaps or discrepancies are identified, they are noted in the gap list for follow-up with a qualified practitioner.
12. Limitation of Liability
Foldward's liability to any client is limited to the amount paid for the specific engagement in question. We are not liable for any indirect, consequential, or financial loss arising from the use or non-use of our deliverables, or from decisions made on the basis of documents we have organised. We are not liable for the conduct or advice of practitioners listed in our directory.
13. Indemnification
The client agrees to indemnify Foldward against any claim arising from the client's misuse of deliverables, the client's failure to obtain proper professional advice, or the client's representation to third parties that Foldward's work constitutes legal or financial advice.
14. Termination
Either party may terminate an engagement in writing. If Foldward terminates due to client conduct (e.g. failure to pay, provision of fraudulently described documents), no refund is due beyond the value of work not yet performed. If the client terminates, the cancellation terms in Section 7 apply.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia. Disputes arising from any Foldward engagement shall first be addressed through written communication between the parties. If unresolved, disputes shall be subject to the jurisdiction of the courts of Sabah, Malaysia.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
17. Changes to These Terms
We may update these Terms when our services or legal obligations change. The updated date at the top of this page reflects when the current version was published. Continued use of our services after an update constitutes acceptance of the revised Terms.
